The Social Media Parental Notification Act was introduced as part of Governor Mike DeWine’s 2023-2024 executive budget, which was presented to the Ohio General Assembly.

COLUMBUS, Ohio – A new proposal led by Ohio Lieutenant Governor John Husted will require certain internet companies to obtain verified parental consent before allowing children under the age of 16 to use their platforms.

The Social Media Parental Notification Act was introduced as part of Governor Mike DeWine’s 2023-2024 executive budget, which was presented to the Ohio General Assembly.

The offer includes social networks and online games such as Facebook, Instagram, YouTube, TikTok and Snapchat.

Social media and online businesses will be required to:

  • Create a parental consent page when users under the age of 16 register an account.
  • Obtain verifiable consent from parents or legal guardians.
  • Send written confirmation of consent to a parent or legal guardian.

If a user indicates that they are under 16 on the screensaver, the following methods can be used to verify:

  • Signing a digital agreement to the terms of service
  • Use a credit card, debit card or other online payment system
  • Call the toll-free number
  • Connect with trained staff via video conference
  • Check the state ID form

If a parent or legal guardian refuses to agree to the terms of service, the company must deny the child access.

Hopefully, this is just the beginning.

“I think there has to be more to it than just what we’re talking about. But we have to start this conversation. We have to get these companies to sit down at the table. They make money from our children. they collect data about them. They install malicious, addictive algorithms there and do nothing in return to protect them. They need to step up and be responsible,” Husted said.

Husted said he expects a pushback, but hopes social media companies will realize they have a responsibility.

“Well, companies know it’s bad, but they make billions of dollars doing it. And now they are doing very little to protect our children,” Husted said.

Companies will have 90 days to comply if they are passed by the Ohio General Assembly and signed by DeWine.
